1. Service Description
Chambazo is a gig marketplace platform that connects workers seeking same-day and short-term employment with employers who need on-demand staffing. Chambazo facilitates the introduction between workers and employers but is not a staffing agency, employer of record, or party to any employment agreement between a worker and an employer.
These Terms of Service govern your access to and use of Chambazo. By creating an account or using the platform, you agree to these Terms. If you do not agree, you may not use the service.
2. User Accounts and Eligibility
- You must be at least 18 years old to use Chambazo.
- Workers must be legally authorized to work in the jurisdiction where they accept gigs. By using Chambazo as a worker, you represent that you have such authorization.
- You must provide accurate, current, and complete information when creating your account.
- You are responsible for maintaining the security of your account credentials.
- Each person or business entity may maintain only one account per role (worker or employer).
- Notify us immediately at legal@chambazo.com of any unauthorized account access.
3. Acceptable Use
You agree not to use Chambazo to:
- Post gigs that are illegal, unsafe, or violate applicable labor laws.
- Misrepresent your skills, experience, or identity as a worker or employer.
- Contact other users outside the platform to circumvent Chambazo's fees.
- Discriminate against workers or applicants based on protected characteristics.
- Scrape, crawl, or extract data using automated means.
- Spam, harass, or intimidate other users.
- Use the platform for any purpose other than genuine gig marketplace activity.
We reserve the right to suspend or terminate accounts that violate these standards at our sole discretion.
4. Payment Processing and Platform Fee
Chambazo charges the employer a 15% platform fee on top of the posted gig rate. Workers receive 100% of the posted rate; no platform fees are deducted from worker earnings. Payment processing is handled by Stripe. By posting or accepting a gig, you agree to the fee structure displayed at the time of booking.
- Worker payouts: Workers are paid via Stripe Express to their connected bank account. Payment is released when the employer confirms job completion and typically reaches the worker's bank within 1–2 business days.
- Employer billing: Employers are charged the agreed gig rate plus the platform fee. All charges are processed via Stripe.
- Disputes: Payment disputes must be raised within 48 hours of gig completion via legal@chambazo.com.
- Employer cancellation fees: Cancelling a confirmed booking more than 24 hours before the gig start is free. Cancelling 2–24 hours before start incurs a fee of 1 hour of the posted rate; under 2 hours before start, 50% of the full gig (capped at 4 hours of the posted rate); after the worker has clocked in, 100% of hours worked with a 2-hour minimum. Cancellation fees are charged per worker booked, collected from the existing payment authorization, and paid in full to the affected worker — Chambazo retains no portion of cancellation fees. The applicable fee is displayed before any cancellation is confirmed.
- Worker cancellations: Workers are never charged monetary fees for cancelling. Worker cancellations affect the worker's Chambazo Score and reliability metrics, with severity scaled to how close to the gig start the cancellation occurs.
5. Worker and Employer Obligations
Workers agree to: arrive on time, complete gigs as described, behave professionally, and not accept gig payments outside the platform. Failure to show up for a confirmed booking without cancellation may result in account suspension.
Employers agree to: provide a safe working environment, pay the agreed rate, treat workers with respect, and comply with all applicable labor and employment laws. Chambazo is not an employer of record — employers are solely responsible for all legal employment obligations arising from their gigs.
6. Data Shared in a Booking
When a booking is confirmed, Chambazo shares limited contact and identity information between the worker and employer as necessary to facilitate the gig (e.g., worker name and contact details with the employer; employer name, location, and contact with the worker). This information must only be used for the purposes of the confirmed gig and not shared further.
7. Intellectual Property
Chambazo and its content, features, and functionality are owned by Chambazo Inc. and are protected by intellectual property laws. You may not copy, modify, or create derivative works without written permission.
8. Limitation of Liability
Chambazo Inc. is not responsible for the actions of workers or employers, the quality of work performed, workplace injuries, theft, or any other outcome of a gig. Chambazo is a marketplace platform only.
To the maximum extent permitted by law, Chambazo's total liability to you shall not exceed the greater of (a) the amounts paid by you to Chambazo in the 3 months preceding the claim or (b) $100. We exclude all liability for indirect, incidental, or consequential damages.
9. Dispute Resolution
These Terms shall be governed by the laws of the State of Delaware. Disputes shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction. You waive any right to a class action.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before the effective date. Continued use constitutes acceptance.
