1. Service Description

Chambazo, a service operated by AAA Incubator LLC ("Chambazo", "we", "our", or "us"), is a gig marketplace platform that connects workers seeking same-day and short-term work with people and businesses who need on-demand help ("gig posters"). Chambazo only facilitates the introduction between users. Chambazo is not a staffing agency, employer, employer of record, joint employer, or party to any agreement between a worker and a gig poster, and does not supervise, direct, or control the performance of any gig.

These Terms of Service ("Terms") govern your access to and use of Chambazo. By creating an account or using the platform, you agree to these Terms and to our Privacy Policy. If you do not agree, you may not use the service.

2. Eligibility and Accounts

  • You must be at least 13 years old to create a Chambazo account and browse the platform. Children under 13 may not create an account.
  • You must be at least 18 years old to use Chambazo — to apply for work, post work, hire, message another user, or receive payment. If you are under 18, your account is view-only.
  • We ask for your date of birth when you sign up so we can apply these rules.
  • We will let you know when more of Chambazo becomes available to your age group.
  • Workers must be legally authorized to work in the jurisdiction where they accept gigs and represent that they hold such authorization.
  • You must provide accurate, current, and complete information and keep it updated.
  • You are responsible for all activity under your account and for keeping your credentials secure.
  • Each person may maintain one personal account and may use the roles available to that account.
  • Notify us immediately at legal@chambazo.com of any unauthorized access.

3. Independent Contractor Relationship

Workers on Chambazo are independent contractors, not employees, agents, partners, or joint venturers of Chambazo, and not employees of one another. Nothing in these Terms creates an employment, agency, partnership, or franchise relationship between you and Chambazo. Any working relationship that arises from a gig is solely between the worker and the gig poster.

Workers are responsible for their own taxes, insurance, licenses, equipment, and for determining how, when, and whether to perform any gig. Gig posters are solely responsible for complying with all applicable labor, tax, wage-and-hour, safety, and worker-classification laws arising from their gigs.

Workers choose which gigs to view, apply to, accept, or decline; may work for anyone else, including competitors; are never required to accept any gig; and provide their own tools except where a gig poster states that equipment is provided on site.

4. Acceptable Use

You agree not to use Chambazo to:

  • Post gigs that are illegal, unsafe, fraudulent, or violate applicable labor laws.
  • Misrepresent your skills, experience, identity, or eligibility.
  • Contact other users to arrange gigs or payments off-platform to circumvent fees.
  • Discriminate against any person based on a protected characteristic.
  • Scrape, crawl, reverse-engineer, or extract data by automated means.
  • Spam, harass, threaten, or intimidate other users.
  • Upload content that is unlawful, infringing, defamatory, or obscene.
  • Interfere with, overload, or attempt to gain unauthorized access to the platform.

We may suspend or terminate accounts that violate these standards at our sole discretion, with or without notice.

5. Payment, Platform Fee & Cancellations

Chambazo charges the gig poster a 15% platform fee on top of the posted rate. Workers receive 100% of the posted rate; no platform fees are deducted from worker earnings. Payment processing is handled by Stripe; by posting or accepting a gig you agree to the fee shown at booking and to Stripe's terms.

How payment works: When a hire is confirmed, the gig poster's payment method is authorized (a hold) for the full amount — payment is secured before work starts, and a worker cannot clock in until it is. If a hold cannot be placed, the spot is reserved, not booked; reservations that are not funded within 24 hours (or by 30 minutes after the scheduled start, whichever is sooner) are released automatically and both sides are notified. On Instant Book gigs, eligible workers reserve the spot when they apply and are booked only after payment is secured. Completed-gig funds are captured on release and paid to the worker's connected account.

  • Worker payouts: Paid via Stripe to the worker's connected account after the gig poster confirms completion — or automatically 24 hours after the shift ends if no dispute is open — typically reaching the bank in 1–2 business days.
  • Gig-poster billing: Charged the agreed rate plus the platform fee via Stripe.
  • Disputes: If something went wrong, open a dispute from the booking (or email legal@chambazo.com) within 24 hours of the shift's scheduled end. If no dispute is open, payment is released to the worker automatically at that point — this protects workers from unpaid completed work. Once released, payments are final except in cases of fraud or as required by law.
  • Gig-poster cancellations: Free more than 24 hours before start; 1 hour of the posted rate if 2–24 hours before; 50% of the gig (capped at 4 hours) if under 2 hours; 100% of hours worked (2-hour minimum) after the worker clocks in. Fees are charged per worker booked, paid in full to the affected worker — Chambazo retains no portion. The fee is shown before any cancellation is confirmed.
  • Worker cancellations: Never charged monetary fees; cancellations affect the worker's Chambazo Score and reliability metrics.

5A. Licensed Pros, Quotes, and Projects

Chambazo also connects customers with independent licensed businesses ("Pros"). Pros are independent businesses, not employees or agents of Chambazo; the contract for any project is solely between the customer and the Pro.

  • Quotes are binding offers. A quote states the fixed price, scope, schedule, and permit responsibility. When a customer accepts a quote, a project is formed at that price between the customer and the Pro.
  • Payment terms are the Pro's to set. Each business decides the payment terms it will accept for a job made through Chambazo — a single payment or milestones, the schedule, any deposit, and any optional site-visit fee — and states them in its quote. By accepting the quote, the customer agrees to those terms. All payments run through Chambazo's secured payment rails; arranging payment off-platform to avoid fees remains prohibited under Section 4.
  • Project payments and milestones. Project funds are secured before work starts — as a single hold or per milestone — and released to the Pro when the customer approves the work (or per the accepted milestone schedule). Released payments are final except in cases of fraud or as required by law. If a customer disputes a milestone before release, the funds stay held while Chambazo's resolution process runs.
  • Optional site visit. A Pro may propose a site visit for a stated fee, shown before you approve it. You are never charged a visit fee unless you approve it.
  • Pro subscriptions and success fees. Pros choose a plan (Free; Pro at $99/month; Pro+ at $249/month; Enterprise by contract). Chambazo charges the Pro a success fee only when a project completes and is paid on Chambazo: 15% on Free, 8% on Pro, and 4% on Pro+, capped per job at $3,000, $1,500, and $900 respectively. The fee rate and cap are locked at quote-send for that quote. Subscriptions bill monthly via Stripe and may be canceled anytime, effective at the end of the billing period. Plans never affect search ranking.
  • Licenses and permits. Chambazo verifies license and insurance documentation Pros submit, where the law requires one, but is not a guarantor of any license's validity or of permit compliance; permits are between the customer and the Pro as stated on the quote.

5B. Chambazo Cash and Promotional Credits

Promotional credits and Chambazo Cash have no cash value, are not redeemable for cash except where required by law, may expire as stated when granted, and may be revoked in cases of fraud or abuse.

6. Worker and Gig-Poster Obligations

Workers agree to arrive on time, perform gigs as described, act professionally, and not solicit payment outside the platform. No-shows on confirmed bookings may result in suspension.

Gig posters agree to provide a safe environment, pay the agreed rate, treat workers with respect, and comply with all applicable laws. Chambazo is not an employer of record — gig posters are solely responsible for all legal obligations arising from their gigs.

7. User Content, Copyright & DMCA Takedown

You retain ownership of content you submit (profile text, photos, gig descriptions, messages, reviews — "User Content"). You grant Chambazo a worldwide, non-exclusive, royalty-free license to host, display, and use your User Content solely to operate and promote the platform. You are solely responsible for your User Content and represent that you have the rights to post it.

Chambazo respects intellectual-property rights and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe content on Chambazo infringes your copyright, send a written notice to our Designated Agent including: (1) your signature; (2) identification of the copyrighted work; (3) the infringing material and its location; (4) your contact information; (5) a statement of good-faith belief that the use is unauthorized; and (6) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act.

We will remove infringing material and, in appropriate cases, terminate repeat infringers' accounts. Material that is the subject of a valid counter-notice may be restored as permitted by the DMCA.

8. Data Shared in a Booking

When a booking is confirmed, Chambazo shares limited contact and identity information between the worker and gig poster as necessary to facilitate the gig. This information must be used only for the confirmed gig and not shared further or used for off-platform solicitation.

Your privacy is governed by our Privacy Policy, which describes the data we collect (including account, usage, device, approximate-location, and marketing-attribution data), how we use it to operate, improve, secure, personalize, and market the service, and the choices and rights you have. By creating an account or using Chambazo, you acknowledge and consent to the data practices described there. We do not sell your personal information.

9. Intellectual Property

Chambazo and its content, features, branding, and functionality are owned by Chambazo and protected by intellectual-property laws. Chambazo™ and the Chambazo logo are trademarks of AAA Incubator LLC (registration pending). You may not copy, modify, distribute, or create derivative works without our written permission.

10. Disclaimer of Warranties

The platform is provided "as is" and "as available"without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Chambazo does not warrant that the service will be uninterrupted, error-free, or secure, and does not guarantee the conduct, reliability, skills, or suitability of any worker or gig poster, the quality or outcome of any gig, or that any gig will be filled or accepted.

11. Assumption of Risk & Release

Gigs involve real-world tasks and in-person interactions that carry inherent risks. You participate voluntarily and assume all risks arising from gigs, including property damage, bodily injury, and the acts or omissions of other users. To the maximum extent permitted by law, you release Chambazo from all claims arising out of or relating to your interactions or transactions with other users. Chambazo does not conduct criminal background checks unless expressly stated; identity verification, where offered, is not a guarantee of safety.

12. Limitation of Liability

Chambazo is not responsible for the actions of workers or gig posters, the quality of work performed, workplace injuries, theft, or any other outcome of a gig. To the maximum extent permitted by law, Chambazo's total liability for any claim shall not exceed the greater of (a) the amounts you paid Chambazo in the 3 months preceding the claim or (b) $100. We exclude all liability for indirect, incidental, special, consequential, or punitive damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless Chambazo and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your User Content, your gigs, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Dispute Resolution & Arbitration

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Except where prohibited, any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association, and you and Chambazo waive any right to a jury trial or to participate in a class action. Either party may seek injunctive relief in a court of competent jurisdiction, and you may bring qualifying claims in small-claims court.

15. Termination

You may stop using Chambazo and delete your account at any time from Settings. We may suspend or terminate your access at any time for violation of these Terms or to protect the platform or its users. Sections that by their nature should survive termination (including payment, IP, disclaimers, liability limits, indemnification, and arbitration) will survive.

16. Apple App Store

If you obtained the Chambazo app through the Apple App Store, these Terms are between you and Chambazo, not Apple. Apple is not responsible for the app or its content and has no obligation to provide support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You represent that you are not located in a U.S.-embargoed country and are not on any U.S. restricted-party list.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before the effective date. Continued use after that date constitutes acceptance. Material changes are versioned: you will be asked to review and accept the current version before continuing to post, quote, or take work.
